What a without prejudice letter is
A "without prejudice" letter is a confidential settlement proposal used to resolve an employment dispute.
Because the document is legally privileged, its contents cannot be disclosed to a court or employment tribunal as evidence of liability. This protection allows both parties to negotiate a financial exit freely and securely outside of formal litigation.
While this rule generally prevents negotiations from being disclosed in court, the protection is not absolute. The letter loses its privilege and becomes admissible as evidence in a court of law if a wrongdoing or crime is admitted by either party in the letter.
When the letter is used
- You have received a settlement offer from your employer and want to respond with your terms.
- You have not received an offer and want to propose settlement. We advise a Case Assessment first to confirm whether you have a valid claim.
What the letter includes
- The claims identified at your Case Assessment
- The settlement terms you propose, based on the value of your claim
- A date by which your employer should reply
What to do
- If you have had a Case Assessment, choose a package and select Book.
- If you have received a settlement offer and have not had a Case Assessment, book the Case Assessment with a package.
- If you have not received an offer, please book a Case Assessment first. This is required because a settlement proposal depends on the legal strength, work circumstances, and financial value of your claim, a formal Case Assessment is required before drafting your letter.
- We draft the letter and send you the final version. You send the letter to your employer.

Why is a Case Assessment needed?
Because a settlement proposal depends on the legal strength, work circumstances, and financial value of your claim, a formal Case Assessment is required before drafting your letter.

I have not received an offer from my employer. What should I do?
Book a Case Assessment (£149 including VAT) first. We will confirm whether you have a valid claim before a without prejudice letter is drafted.
What is the difference between the two packages?
Package 1 is the without prejudice letter only. Package 2 includes the without prejudice letter and up to two reviews of your employer's replies, each with a drafted response.
Do I need to upload any documents?
No. We draft the without prejudice letter using the findings of your Case Assessment.
Is this the same as Document Review?
No. Document Review is feedback on a document you have written. The without prejudice letter is drafted for you.
Is VAT added to the price?
Yes. The without prejudice letter prices are shown before VAT, and VAT at 20% is added. The £149 Case Assessment price includes VAT.
