Can I go off sick whilst suspended from work?
Yes. An employee who becomes unwell during suspension can report sickness through the employer’s absence procedure. Suspension does not prevent illness being recorded. The effect on pay and meeting attendance depends on the contract, policy, medical circumstances and the employer’s proposed arrangements.
Report the illness through the correct route
Check the sickness reporting instructions and the named contact during suspension. Explain the dates and provide the evidence required by the absence process. Keep copies of the communication and any medical information submitted.
Ask the employer to confirm how it is recording the absence. Sickness and suspension describe different matters, so it is useful to know which status it is applying for pay and attendance purposes. Do not rely on assumptions about a payroll change.
Will suspension pay become sick pay?
ACAS advises checking the contract. A contractual promise of full pay during suspension may continue to apply even when the employee is sick. An automatic switch to a lower amount needs examination of the wording and circumstances.
Request the contractual basis and calculation for any proposed reduction. Compare the response with the suspension letter, sick pay terms and payslip. Identify the amount and dates in dispute instead of relying on a general complaint about unfair treatment.
Does a fit note stop the investigation?
A fit note concerns health and fitness for work. It does not automatically determine fitness for every form of participation in an investigation. The employer needs to consider the circumstances and possible arrangements.
If attending would create a health difficulty, explain the barrier and seek medical advice about participation. An alternative location, shorter meeting, breaks or written questions may address some difficulties. A disabled employee may also need reasonable adjustments.
What if the employer wants to continue?
Ask what participation it proposes and how it has considered the information provided. If a meeting cannot take place, discuss an alternative date or method. Keep the response so an adviser can examine the decision rather than only the fact a meeting went ahead.
In some circumstances, an employer may decide it is reasonable to continue without the employee. This can affect the evidence available to the investigator. Explain what account or documents you can provide and what remains impossible for medical reasons. Silence leaves the employer without this explanation.
Keep the issues separate
A dispute about pay, a need for medical support and a concern about the allegation may require different responses. Record each issue with its documents. This helps avoid an employer answering the sickness question while leaving the pay calculation or investigation concern unaddressed.
Questions employees ask
Will sickness end the suspension? Not automatically. Ask the employer to confirm the continuing suspension decision and how it will review it.
Can I be disciplined for being ill? Illness does not prove misconduct. However, an employer may examine compliance with reporting requirements or another separate concern. The reason for any proposed action needs assessment.
Must I attend despite medical advice? Tell the employer about the relevant medical restriction and request an appropriate arrangement. Obtain advice if the employer rejects it rather than assuming attendance or nonattendance has one automatic legal result.
